Almost none of these <a href=\"https:\/\/doctors108.com\/articles\/for-doctors\/national-health-claims-exchange-nhcx-what-hospitals-must-know\/\">claims<\/a> reflect what Indian regulation actually permits. Everything else, including stem cell use for orthopaedic conditions, neurological disorders, <a href=\"https:\/\/doctors108.com\/articles\/for-doctors\/smart-doctor-cdss-ai-rolling-out-across-70000-hospitals\/\">diabetes<\/a>, cosmetic applications, and anti-ageing treatments, is explicitly classified as investigational and permitted only within the framework of a properly approved clinical trial.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The guidelines are direct on this point: no stem cell administration to humans is permitted outside the purview of an approved clinical trial, except for the specific blood-disorder therapies already established as <a href=\"https:\/\/doctors108.com\/articles\/for-doctors\/consumer-protection-act-medical-negligence-what-to-know\/\">standard of care<\/a>. A clinic offering stem cell injections for joint pain or neurological recovery as a routine paid treatment, rather than as part of a registered trial, is operating outside what the guidelines permit.<\/p>\n\n\n\n<h2 id=\"why-advertising-these-claims-is-a-separate-compounding-problem\" class=\"wp-block-heading\">Why Advertising These Claims Is a Separate, Compounding Problem<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Even setting aside whether a given stem cell treatment is scientifically justified, advertising it is independently restricted under the Drugs and Magic Remedies (Objectionable Advertisements) Act, 1954, which prohibits misleading advertisements claiming a drug or remedy can cure conditions it has not been proven to treat. The Indian Medical Council&#8217;s Professional Conduct, Etiquette and Ethics Regulations, 2002 separately treat direct or indirect patient <a href=\"https:\/\/doctors108.com\/articles\/for-doctors\/how-to-get-more-5-star-reviews-on-google\/\">solicitation<\/a> through advertising as unethical conduct for a registered medical practitioner.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Advertising Standards Council of India has monitored stem-cell-related advertisements since 2015, working alongside the National Apex Committee for Stem Cell Research and Therapy, and has repeatedly found that promotional material from clinics and hospitals in this space is deceptive or lacks the comprehensive, accurate information required for a lawful health <a href=\"https:\/\/doctors108.com\/articles\/for-doctors\/the-3-hour-cashless-claim-rule-what-it-means-for-hospitals\/\">claim<\/a>.<\/p>\n\n\n\n<h2 id=\"the-enforcement-gap-clinics-have-exploited\" class=\"wp-block-heading\">The Enforcement Gap Clinics Have Exploited<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The uncomfortable reality is that ICMR and the Department of Biotechnology have no direct enforcement power over individual clinicians. ICMR&#8217;s role is limited to research coordination and guideline formulation, and DBT&#8217;s mandate is to promote biotechnology, not police clinical practice. Neither body can compel a clinic to stop offering an unproven stem cell treatment, which is precisely why the guidelines point instead to other statutes, the Drugs and Magic Remedies Act, ASCI&#8217;s advertising code, and medical ethics regulations, as the practical levers available to challenge misleading claims.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This fragmented enforcement structure has allowed an estimated several hundred clinics across India to continue offering unproven stem cell therapies commercially, according to figures cited by ICMR itself, despite guidelines that have explicitly prohibited commercial use of stem cells as elements of therapy since 2017.<\/p>\n\n\n\n<h2 id=\"what-legitimate-clinics-should-do-differently\" class=\"wp-block-heading\">What Legitimate Clinics Should Do Differently<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A clinic genuinely offering an investigational stem cell treatment should only do so within a registered clinical trial that has secured ethics committee approval and, where applicable, <a href=\"https:\/\/doctors108.com\/articles\/for-doctors\/cdscos-new-software-as-a-medical-device-rules-explained\/\">CDSCO<\/a> clearance, with <a href=\"https:\/\/doctors108.com\/articles\/for-doctors\/can-doctors-refuse-to-treat-abusive-patients-the-real-answer\/\">patients<\/a> enrolled as trial participants under informed <a href=\"https:\/\/doctors108.com\/articles\/for-doctors\/dpdp-act-2023-for-doctors-what-patient-data-rules-require\/\">consent<\/a> rather than as paying customers of a marketed treatment.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Advertising language should avoid outcome claims such as &#8216;cure&#8217; or &#8216;reverse&#8217; for any condition outside the narrow set of ICMR-approved haematopoietic indications, and any <a href=\"https:\/\/doctors108.com\/articles\/for-doctors\/building-trust-through-better-patient-communication\/\">communication<\/a> about investigational use should clearly state that the treatment is unproven and offered only within a clinical trial framework, both to stay within advertising law and to give patients an honest basis for consent.<\/p>\n\n\n\n<h2 id=\"conclusion\" class=\"wp-block-heading\">Conclusion<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The gap between what stem cell clinics in India often advertise and what Indian guidelines actually permit remains wide, largely because the bodies that set the rules cannot themselves enforce them.
